Terms of Service.
These terms are the agreement between you and Rack'Em Ind when you create an account or use our servers. Please read them. By ticking the box when you sign up, you agree to them.
1. Who we are
Rack'Em Ind (“Rack'Em”, “we”, “us”) is a venture of Karma Enterprises, based in Bengaluru, India. You can reach us at karmaenterprises2021blr@gmail.com.
2. Your account
- You must be at least 18 years old, or have the consent of a parent or guardian.
- Give us a real email address that you control. You're responsible for everything done through your account.
- We review new accounts and may decline or close an account at our discretion, especially to prevent abuse.
- One person or business may hold more than one account only with our permission.
3. The service
We provide virtual private servers (“servers”) running in professional data centres operated by our infrastructure partners. You get root access and are responsible for what runs on your server: software, updates, security, firewalls and backups.
We aim for high availability but don't guarantee uninterrupted service. Maintenance, network issues or events outside our control can cause downtime. Keep your own backups of anything important. We are not responsible for data lost from a server.
4. Acceptable use
You must follow our Acceptable Use Policy. It is part of these terms. Breaking it is a serious breach and can lead to immediate suspension or termination, without notice and without refund.
5. Suspension and termination
- We may suspend or shut down a server immediately if we reasonably believe it is being used for abuse, is under attack, is putting our network or other customers at risk, or if the law or our infrastructure partners require it.
- Where it's safe and lawful, we'll tell you why and give you a chance to fix the problem.
- You can delete your servers and close your account at any time from the dashboard.
- When a server is deleted, its data is erased and cannot be recovered.
6. Prices and payment
- Rack'Em is prepaid. You add money to a wallet in your account, by UPI, card or netbanking through our payment partner Razorpay.
- Servers are charged from your wallet for the time they exist, at the plan's monthly price divided by 730 hours. Servers that are switched off are still charged, because their resources stay reserved for you. Deleting a server stops the charges.
- Prices are in Indian rupees and exclude GST. 18% GST is added when you top up, and your wallet is credited with the amount before GST.
- Yearly plans are paid upfront from your wallet for 12 months, at a discount. When the year ends, the plan renews automatically if your wallet covers another year; otherwise the server continues on hourly billing. If you delete a yearly server early, the unused part of the year isn't refunded.
- To create a server, your wallet must hold at least seven days of that server's price.
- If your balance runs out, your hourly servers are switched off until you top up. If it stays empty, we email you a final reminder after 3 days, and the servers and their data are deleted after 7 days.
- Unused credit can be refunded on request, minus any payment fees. Credit isn't refunded when an account is closed for breaking these terms.
- If we change prices, we'll tell you by email at least 14 days before. Changes don't apply to servers you already have until then.
7. Your content and your responsibility
You own what you put on your servers. You are responsible for it being lawful and for having the rights to it. You agree to cover any loss, claim or cost we (or our infrastructure partners) face because of your content, your use of the service, or a breach of these terms by you or anyone using your account.
8. Limits on our liability
To the extent the law allows, the service is provided “as is”. We are not liable for indirect or consequential losses, lost profits or lost data. Our total liability to you is limited to the amount you paid us in the three months before the claim.
9. Changes to these terms
We may update these terms. When we do, we'll change the date at the top and ask you to accept the new version before you continue using the dashboard.
10. Law and disputes
These terms are governed by the laws of India. Any dispute will be handled by the courts in Bengaluru, Karnataka.
